DATA FINLAND TERMS OF SERVICE

The Ministry for Foreign Affairs of Finland has set these Data Finland Terms of Service (“ Terms of Service”) to govern access and use of Data Finland Services and all its affiliated websites and tools, collectively called as “ Data Finland Services”.

The Data Finland offers a data intermediary service for public and private organizations to start providing and using productized and standardized data between disconnected applications and data sources for improved end user experience in the web services.

Please read these Terms of Service carefully. You agree that by accessing the Data Finland Services, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with these Terms of Service, then you are expressly prohibited from using the Data Finland Services and you must discontinue use immediately.

DEFINITIONS AND SCOPE

These Terms of Service concern the following roles commonly referred as ” Data Finland Service Users” or ” Users” and within these Terms of Service have the following meaning:

Service Provider: Create web applications using one or many data products from Data Finland Service for generating value for the end users of their web applications subcontracted or not subcontracted with one or many application developers.

Data Provider: Provides one or many data products for the benefit of one or more web applications subcontracted or not subcontracted with one or many data product developers.

Application developer: Application developer is an individual belonging or not belonging to an organization and registering to the Data Finland Services to integrate one or several applications with the Data Finland data intermediary service and under a contract of a Service Provider.

Data product developer: Data product developer is an individual belonging or not belonging to an organization and registering to the Data Finland Services to integrate one or several data sources with Data Finland data intermediary service and under the contract of a Data Provider.

The Terms of Service hereby incorporate and supplement the “ Data Finland Maintenance Agreement” that the Ministry for Foreign Affairs has signed with the Service and/or Data Providers entering to use the Data Finland’s data intermediary service. The Terms of Data Finland Maintenance Agreement also apply to Application and Data product developers and they must make sure to be aware of the Terms of Data Finland Maintenance Agreement agreed by the Service or Data Provider that the developer has contracted with.

In case of any ambiguity, conflict or inconsistency between these Terms of Service and the Data Finland Maintenance Agreement, the issues will be resolved interpreted in the following order:

  1. Data Finland Maintenance Agreement
  2. These Data Finland Terms of Service

THE USE OF DATA FINLAND SERVICES

The Data Finland Services are currently applicable for sharing open as well as data requiring low level authentication (email based authentication) between Service and Data Providers. The Data Finland Services do not support the sharing of any sensitive personal or other critical or security classified data.

It is the responsibility of the Data Finland Service Users to make sure that the applications and data sources connected to the Data Finland Services respects these Terms of Service as well as all local laws and regulations when using the Data Finland Services. Any personal data exchanged via the Data Finland must be processed in accordance with the applicable data protection laws and regulations. If there is a reasonable ground to believe that a Data Finland Service User has violated any provision of these Terms of Service or applicable law, the Ministry for Foreign Affairs has the right to suspend the use of or deny the access to the Data Finland Services. 

PRIVACY POLICY

The Ministry for Foreign Affairs is fully committed to the data privacy and security matters. Please review the Privacy Policy of the Data Finland Services for understanding how the personal data related to the Data Finland Service accounts is being processed. By using the Data Finland Services, the Data Finland Service Users agree to be bound by the Privacy Policy, which is incorporated into these Terms of Service. Please be advised the Data Finland Services are hosted in the European Union.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, all the content of the Data Finland Services including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Data Finland Services as well as the trademarks, service marks, and logos contained therein are owned or controlled or licensed to the Ministry of Foreign Affairs, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the European Union, foreign jurisdictions, and international conventions.

The content and trademarks are provided on the Data Finland Services “AS IS” for the information and personal use of Data Finland Service Users only. Except as expressly provided in these Terms of Service, no part of the Data Finland Services and no content or trademarks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without a prior written permission from the Ministry for Foreign Affairs.

THIRD PARTY WEBSITES AND CONTENT

The Data Finland Services may contain (or the Data Finland Service Users may be sent via the Data Finland Services) links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties ("Third-Party Content").

Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness the Ministry for Foreign Affairs and is not responsible for any Third-Party Websites accessed through the Data Finland Services or any Third-Party Content posted on, available through, or installed from the Data Finland Services, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content.

Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by the Ministry for Foreign Affairs. If the Data Finland Service Users leave the Data Finland Services and access the Third-Party Websites or to use or install any Third-Party Content, the Users do so at their own risk, and they should be aware these Terms of Service no longer govern.

The Data Finland Service Users should review the applicable terms and policies, including privacy and data gathering practices, of any website to which that is navigated from the Data Finland Services or relating to any applications is used or installed via the Data Finland Services. Any potential purchases that is made through Third-Party Websites will be through other websites and from other legal entities, and no responsibility whatsoever is taken by the Ministry for Foreign Affairs in relation to such purchases which are exclusively between the Data Finland Service Users and the applicable third party.

MODIFICATIONS AND INTERRUPTIONS

The Ministry for Foreign Affairs reserves the right to change, modify, or remove the Data Finland Service as per what has agreed in the Data Finland Maintenance Agreement.

The Ministry for Foreign Affairs cannot guarantee the Data Finland Services will be available at all times and the Data Finland Services may experience hardware, software, or other problems or need to perform maintenance related to the Data Finland Services, resulting in interruptions, delays, or errors.

There may be information on the Data Finland Services that contains typographical errors, inaccuracies. The Ministry for Foreign Affairs reserves the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Data Finland Services at any time, without prior notice.

LIMITATION OF THE LIABILITY

The Data Finland Services are provided for the use of Service and Data providers with limited availability and service support in accordance with Data Finland Maintenance Agreement and the ministry for Foreign Affairs is liable for direct damage only to the extend what has been identified in that agreement. The Data Finland Service Users acknowledge and agree that the uninterrupted availability and use of the Data Finland Services cannot be guaranteed. The Ministry for Foreign Affairs is and not liable for any indirect damages.

GOVERNING LAW AND DISPUTE RESOLUTIONS

The Data Finland Services are governed in accordance with the laws of Finland. Any dispute, controversy or claim arising out of or relating to these Terms of Service, or the breach, termination or validity thereof must be submitted in written to the contact address provided in these Terms of Service. If some or all of the issues in the dispute are not resolved in the negotiation, the dispute shall be submitted to the District Court of Helsinki.

ENTRY IN THE FORCE, APPLCIATION AND TERMINATION

These Terms of Service enter into force when accepting and starting to use the Data Finland Services until terminated in one month’s notice unless otherwise stated in the Data Finland Maintenance Agreement. These Terms of Service shall remain in full force and effect while using the Data Finland Services.

The Ministry for Foreign Affairs may at its discretion terminate the effective immediately, if it comes to The Ministry for Foreign Affairs’ knowledge that the data, software, service, or any activity of a Data Finland User is violating these terms of Service, Data Finland Maintenance Agreement or any applicable law. Upon termination the Data Finland Service User shall immediately discontinue all use of the Data Finland Services.

It is the responsibility of the Data Finland Users to stay up to date and review any updates made in these Terms of Service. The modifications and amendments will be alerted to the Data Finland Users by updating the ’last updated’ date of these Terms and conditions.
